Notice of Privacy Practices (HIPAA / HB 300)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Effective date: 9/1/2026. This Notice is provided by KindWell Primary Care, PLLC (“we,” “us”).

How we may use and disclose your health information

Treatment, Payment, and Health Care Operations. We may use and disclose your protected health information (“PHI”) to provide and coordinate your care, to obtain payment for services, and for our routine business operations.

Other permitted uses. We may use or disclose PHI without your authorization where the law permits or requires it – for example, for public health activities, to avert a serious threat to health or safety, for health oversight, in judicial proceedings, to law enforcement as allowed, and as otherwise required by law. Other uses and disclosures will be made only with your written authorization, which you may revoke.

Your rights

  • Access – inspect and obtain a copy of your PHI, in the form you request when readily producible.
  • Amendment – request that we amend PHI you believe is incorrect or incomplete.
  • Accounting of disclosures – request a list of certain disclosures we have made.
  • Restrictions – request limits on certain uses and disclosures.
  • Confidential communications – ask that we contact you by a specific means or at a specific location.
  • Paper copy – obtain a paper copy of this Notice on request.
  • Breach notification – be notified if there is a breach of your unsecured PHI.

Our duties; Texas-specific notice

We are required by law to protect the privacy of your PHI, to provide this Notice, and to follow the terms of the Notice currently in effect. Under Texas law (HB 300, Tex. Health & Safety Code ch. 181), we notify you that your PHI is subject to electronic disclosure; where required, we will obtain your authorization for electronic disclosures of PHI. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have.

Complaints and contact

If you believe your privacy rights have been violated, you may complain to us and to the U.S. Department of Health and Human Services, Office for Civil Rights, without retaliation.
